Some clients have the mistaken belief that because they were "following the flow of traffic," that they should not have received a citation (or their citation should be dismissed). This is not true. As one Judge in Ventura County put it: "Are you saying that if 15 of us agree now to get on the freeway and go 95 mph on the freeway from here to Los Angeles, and an officer pulls one of us over, we can say we were just following the flow of traffic?"
There are more clever and legal ways to fight traffic tickets. For example, if the radar gun used was not properly calibrated, or if the officer was not properly trained, there could be some grounds for a dismissal. Also, if there were not proper surveying of the citation location, the citation could be dismissed.
Sometimes, officers are trained at visual estimation of speed. If their training qualifies them as an expert, the judge may allow the officer to testify as to what he believes the speed to have been. This form of testimony, although admissible, will probably not be enough to get a conviction. There usually needs to be more corroborating evidence. For example, if the officer performed a visual estimation, plus, the officer followed the driver, there would be more persuasive evidence for a guilty judgment.
